Matched songs appear unaffected for most users. It then moves to the next download and most times is succsesful.  I am getting this error in the last few hours and to about 10-20% of my downloads.&lt;/blockquote&gt;The Verge &lt;a href="http://www.theverge.com/2012/2/3/2768797/uploaded-itunes-match-music-unavailable-streaming-download"&gt;confirms that the issue&lt;/a&gt; occurs in both iTunes 10.5.2 and 10.5.3, and on both Snow Leopard and Lion.

There has been no word from Apple about the outage and the iCloud &lt;a href="http://www.apple.com/support/icloud/systemstatus/"&gt;System Status page&lt;/a&gt; does not reflect any current issues.

This isn't the first issue that Apple has run into with iTunes Match in recent days. Apple is reportedly &lt;a href="http://9to5mac.com/2012/02/02/apple-working-on-fix-for-itunes-match-bug-that-matches-explicit-songs-as-clean/"&gt;investigating a problem&lt;/a&gt; with songs with explicit lyrics being converted from "explicit" to "clean" after being matched.&lt;br/&gt;

		<description>Several Apple TV users have &lt;a href="http://forums.macrumors.com/showthread.php?t=1318755"&gt;reported&lt;/a&gt; a new addition to the menus of their devices, with the new option bringing Genius recommendations for movies and TV shows in their libraries.  Curiously, early reports noted that rather than carrying a correct menu title, the movie option carried the name "ATV.Menu.MOVIE.GeniusItem", suggesting that the new feature may have appeared prematurely.  Apple seems to have fixed the issue, however, with the menu option now showing properly as "Genius".

Despite the strange display of the menu option, the feature does appear to have been functional since its initial appearance yesterday, with users being able to access Genius recommendations for their content.

		<title>Apple Clarifies iBooks Author Licensing Situation in New Software Update</title>

		<description>&lt;img src="http://images.macrumors.com/article-new/2012/02/ibooks_author_icon-150x150.jpg" alt="" title="ibooks_author_icon" width="150" height="150" class="alignright size-medium wp-image-335588" /&gt;Following Apple's release of &lt;a href="http://appshopper.com/mac/productivity/ibooks-author"&gt;iBooks Author&lt;/a&gt; last month to support creation of iBooks Textbooks, significant &lt;a href="http://www.macrumors.com/2012/01/19/a-closer-look-at-ibooks-author-textbooks-and-exclusivity/"&gt;controversy&lt;/a&gt; arose regarding the software's licensing, which specified that the output from the software could only be sold via the iBookstore and not any other marketplace.
&lt;br/&gt;

&lt;br/&gt;
Some confusion had resulted from Apple's language, with some believing that Apple was claiming rights to all content used in the production of the iBooks Textbooks, perhaps attempting to exclude books from being published in any other form.
&lt;br/&gt;

&lt;br/&gt;
Apple has now addressed the issue by releasing an update to iBooks Author that includes a modified licensing agreement to clarify that Apple claims rights only to the .ibooks document format itself, with authors being free to distribute their content in non-.ibooks formats however they wish.
&lt;br/&gt;

&lt;br/&gt;
One key clarification comes in the "important note" included at the beginning of the license agreement.  Previously, the note read:&lt;blockquote&gt;If you charge a fee for any book or other work you generate using this software (a “Work”), you may only sell or distribute such Work through Apple (e.g., through the iBookstore) and such distribution will be subject to a separate agreement with Apple.&lt;/blockquote&gt;Apple has now clarified the note to read:&lt;blockquote&gt;If you want to charge a fee for a work that includes files in the .ibooks format generated using iBooks Author, you may only sell or distribute such work through Apple, and such distribution will be subject to a separate agreement with Apple. This restriction does not apply to the content of such works when distributed in a form that does not include files in the .ibooks format.&lt;/blockquote&gt;A second clarification comes in section 2B, which addresses distribution of works created using iBooks Author.  Subsection (ii) previously read:&lt;blockquote&gt;[I]f your Work is provided for a fee (including as part of any subscription-based product or service), you may only distribute the Work through Apple and such distribution is subject to the following limitations and conditions: (a) you will be required to enter into a separate written agreement with Apple (or an Apple affiliate or subsidiary) before any commercial distribution of your Work may take place; and (b) Apple may determine for any reason and in its sole discretion not to select your Work for distribution.&lt;/blockquote&gt;With the updated terms, Apple has reworded this section and added bold text addressing ownership of the original content:&lt;blockquote&gt;[I]f the work is provided for a fee (including as part of any subscription-based product or service) and includes files in the .ibooks format generated using iBooks Author, the work may only be distributed through Apple, and such distribution will be subject to a separate written agreement with Apple (or an Apple affiliate or subsidiary); &lt;b&gt;provided, however, that this restriction will not apply to the content of the work when distributed in a form that does not include files in the .ibooks format generated using iBooks Author&lt;/b&gt;. You retain all your rights in the content of your works, and you may distribute such content by any means when it does not include files in the .ibooks format generated by iBooks Author.&lt;/blockquote&gt;iBooks Author 1.0.1 with the updated license agreement is a free download from the Mac App Store, but weighs in at the application's full size of roughly 140 MB.&lt;br/&gt;

&lt;i&gt;asymco&lt;/i&gt;'s Horace Dediu has released his &lt;a href="http://www.asymco.com/2012/02/03/first-apples-rank-in-mobile-phone-profitability-and-revenues/"&gt;latest calculations&lt;/a&gt; of revenue and profits in the global mobile phone industry, finding that Apple has increased its share of the top vendors' profits to 75%.  Samsung followed in second place with 16% of industry profits while no other vendor accounted for more than 4% of profits.&lt;blockquote&gt;Apple reached 75% of profit share, nearly 40% of revenue share and 9% of units share.
&lt;br/&gt;

&lt;br/&gt;
Apple and Samsung combined for about 91% of profits with RIM third at 3.7%, HTC fourth at 3.0% and Nokia last at 1.8% of a &amp;#36;15 billion total for the quarter.&lt;/blockquote&gt;Dediu's analysis covers eight top mobile phone vendors: Apple, Samsung, Nokia, Research in Motion, HTC, LG, Motorola, and Sony Ericsson.  While the numbers do not include a few major players such as China's ZTE for which public numbers are not available, his analysis does provide a relatively solid picture of the industry.

According to Dediu's numbers, Apple has held the top spot in profits for 13 quarters in row since overtaking Nokia, and now dominates the industry with its 75% share of profits.  Apple succeeds by generating high profitability on high-end devices, enabling it to take the majority of profits while still controlling less than 10% of unit sales.&lt;br/&gt;

&lt;br/&gt;

&lt;br/&gt;
Security Update 2012-001 was &lt;a href="http://www.macrumors.com/2012/02/01/apple-releases-os-x-10-7-3-with-new-language-support-and-bug-fixes/"&gt;released alongside OS X 10.7.3&lt;/a&gt; on Wednesday in order to bring some of the security fixes found in OS X 10.7.3 to users still running Mac OS X Snow Leopard.  But as noted in several discussions at Apple's forums (&lt;a href="https://discussions.apple.com/thread/3703894"&gt;1&lt;/a&gt;, &lt;a href="https://discussions.apple.com/thread/3706294"&gt;2&lt;/a&gt;, &lt;a href="https://discussions.apple.com/thread/3704759"&gt;3&lt;/a&gt;) and elsewhere, users are experiencing a variety of problems with Rosetta apps following the update, including repeated crashes when trying to use any commands from the applications' main dropdown menus.
&lt;br/&gt;

&lt;br/&gt;
Users are reporting a significant number of applications being affected by the issue, including Microsoft Office X and 2004, older versions of Adobe Photoshop, Quicken, Filemaker 7, and various other applications that had been written to run on PowerPC chips used in Apple's older machines.
&lt;br/&gt;

&lt;br/&gt;
With Apple's transition to Intel, the company developed the Rosetta framework to allow those applications to continue to function on new hardware.  Apple has discontinued Rosetta in OS X Lion, but it was still included as an optional install in Mac OS X Snow Leopard and a number of users have continued to use PowerPC applications on those systems either because they do not wish to upgrade or because newer versions are simply not available.
&lt;br/&gt;

&lt;br/&gt;
As &lt;a href="https://discussions.apple.com/thread/3706348"&gt;noted in the Apple discussion forums&lt;/a&gt;, one user has worked to &lt;a href="http://www.educate-it.org/content.php?130-Rosetta-Issue-after-Security-Update-2012-001"&gt;create a patch&lt;/a&gt; to address the issue, but the patch does not yet appear to work for all Rosetta applications.&lt;blockquote&gt;This is a band-aid and is only recommended in emergency situations. Apple is currently working on a fix, but until that happens, we are stuck with reverse-engineering their update. I hope this helps those in distress from this update.&lt;/blockquote&gt;Those who have spoken to Apple customer service about the issue have received varying responses, from notes that the company doesn't yet know what the problem is to claims that there is no issue and that Rosetta support has simply been discontinued, with the latter being unlikely to be true given that the change occurred with a minor security update.&lt;br/&gt;

The devices, which include the 3G iPad 2, iPhone 4, and iPhone 3GS, remain available from Apple's physical stores and other resellers in the country.

The removal is related to enforcement of a &lt;a href="http://www.macrumors.com/2011/12/09/motorola-wins-preliminary-injunction-could-bar-sales-of-iphone-and-3g-ipad-in-europe/"&gt;December injunction&lt;/a&gt; focused on a Motorola patent on 3G GPRS technology.&lt;blockquote&gt;“While some iPad and iPhone models are not available through Apple’s online store in Germany right now, customers should have no problem finding them at one of our retail stores or an authorized reseller,” [Apple spokesman Alan] Hely said.&lt;/blockquote&gt;Beyond the 3G issue, Motorola has also won an injunction against Apple related to its &lt;a href="http://www.macrumors.com/2011/11/18/apple-claims-potential-injunction-against-icloud-could-result-in-2-7-billion-loss/"&gt;iCloud services&lt;/a&gt;.  Motorola has yet to seek enforcement of that ban, but could do so if it elected to post a &amp;#36;132 million bond to help cover penalties if it ultimately loses the case on appeal.

Apple is appealing both decisions, but has apparently agreed to remove the numerous 3G devices from its German online store while the process remains ongoing.

&lt;b&gt;Update&lt;/b&gt;: &lt;a href="http://www.slashgear.com/apple-sales-injunction-suspended-german-ipadiphone-sales-resume-03211975/"&gt;&lt;i&gt;SlashGear&lt;/i&gt; reports&lt;/a&gt; that Apple has issued a statement claiming that the 3G GPRS injunction has already been suspended and that the affected iPhone and iPad devices will return to the German online store "shortly".&lt;blockquote&gt;Apple has been granted a suspension of the German injunction against 3G-enabled iOS devices, with the iPad WiFi + 3G, iPhone 4 and other gadgets back on sale through the company’s online store. ”All iPad and iPhone models will be back on sale through Apple’s online store in Germany shortly” the company told us in a statement. “Apple appealed this ruling because Motorola repeatedly refuses to license this patent to Apple on reasonable terms, despite having declared it an industry standard patent seven years ago.”&lt;/blockquote&gt;&lt;b&gt;Update 2&lt;/b&gt;: The affected devices are now available again in the German online store.&lt;br/&gt;

In the initial press release announcing the hire, Cook &lt;a href="http://www.macrumors.com/2012/01/31/apple-announces-john-browett-as-senior-vice-president-of-retail/"&gt;went even further&lt;/a&gt;, saying that "John shares that commitment [to customer service] like no one else we’ve met."

He must have spent at least 30 minutes with us, explaining the pros and cons of LCD vs plasma, and the best deals available. An excellent impression.

		<title>iMessages Going to Wrong iPhone "Isn't a Bug" Claims Apple</title>

		<description>In December, an apparent bug &lt;a href="http://www.macrumors.com/2011/12/15/imessage-bug-sends-texts-to-stolen-iphones/"&gt;appeared in Apple's iMessage service&lt;/a&gt; that allowed iMessages to be sent to a stolen iPhone. Earlier this week, &lt;em&gt;Gizmodo&lt;/em&gt; reported that a customer who went to Apple's Genius Bar &lt;a href="http://gizmodo.com/5880593/the-apple-bug-that-let-us-spy-on-a-total-strangers-iphone"&gt;began receiving iMessages&lt;/a&gt; to and from the Genius who helped fix their phone.
&lt;br/&gt;

&lt;br/&gt;
It appears that the Genius took his personal SIM card and inserted it into the customer's iPhone as part of a series of unofficial and unapproved diagnostic efforts to fix the customer's phone. An Apple representative explained to &lt;em&gt;The Loop&lt;/em&gt;'s Jim Dalrymple that the issue in the &lt;em&gt;Gizmodo&lt;/em&gt; story wasn't a bug, but instead was the result of the Genius &lt;a href="http://www.loopinsight.com/2012/02/02/reported-imessage-bug-is-not-a-bug-says-apple/"&gt;not following protocol&lt;/a&gt;.
&lt;br/&gt;
&lt;blockquote&gt;“This was an extremely rare situation that occurred when a retail employee did not follow the correct service procedure and used their personal SIM to help a customer who did not have a working SIM,” Apple representative Natalie Harrison told The Loop. “This resulted in a temporary situation that has since been resolved by the employee.”&lt;/blockquote&gt;The act of installing an employee's personal SIM card into a customer's iPhone is obviously not an approved procedure at the Genius Bar. However, the fact that the Genius wasn't supposed to perform this act does not mean that this was merely an "extremely rare situation".

In the &lt;a href="http://gizmodo.com/5880593/the-apple-bug-that-let-us-spy-on-a-total-strangers-iphone"&gt;Gizmodo situation&lt;/a&gt;, a customer was having difficulties with her iPhone 4 and took it to the Genius Bar to be serviced. When it was returned, the phone was in perfect working order, except for one thing: it displayed every incoming and outgoing iMessage meant for the Genius. Because he had inserted his personal SIM card into the iPhone during the diagnostic process, it registered with Apple's iMessage servers and began sending all of his messages to the customer's phone.

A number of customers have reported similar iMessage issues, including messages continuing to go to a stolen iPhone &lt;a href="http://www.macrumors.com/2011/12/15/imessage-bug-sends-texts-to-stolen-iphones/"&gt;after a remote wipe and a SIM card deactivation&lt;/a&gt;. This is obviously an unintended action, and though Apple &lt;a href="http://www.loopinsight.com/2012/02/02/reported-imessage-bug-is-not-a-bug-says-apple/"&gt;explains&lt;/a&gt; the solution to be "toggle iMessage on and off" in the Settings app, that is an impossible act to perform remotely on a stolen phone.

Apple will not hold an event in February, unusual or otherwise. While one piece of information about new &lt;a href="http://www.macrumors.com/2012/01/26/apple-to-give-employees-500-off-macs-and-250-off-ipads/"&gt;employee hardware discounts&lt;/a&gt; did surface, little else from that meeting has made its way off of Apple's campus.

&lt;a href="http://www.theverge.com/2012/2/2/2766403/tim-cook-apple-charity-project-red-stanford"&gt;&lt;i&gt;The Verge&lt;/i&gt; now reports&lt;/a&gt; that it has been hearing that discussion of the company's philanthropic efforts was a notable focus of the event, with Tim Cook spending "quite a bit of time" talking about the company's work in that area.  One of Cook's first visible actions as CEO was to institute a &lt;a href="http://www.macrumors.com/2011/09/08/apple-institutes-new-charitable-matching-program-for-employees/"&gt;charitable matching program&lt;/a&gt; for employees under which the company would match donations up to &amp;#36;10,000 per employee per year, a move that marked a distinct departure for Apple following the Steve Jobs era.  That program resulted in &lt;a href="http://www.macrumors.com/2011/11/10/apple-and-employees-give-2-6-million-to-charity-through-donation-matching-program/"&gt;&amp;#36;2.6 million in donations&lt;/a&gt; in its first two months of existence.

According to &lt;i&gt;The Verge&lt;/i&gt;, Cook disclosed at the town hall meeting that Apple has also given &amp;#36;50 million to Stanford University's hospitals, divided equally among projects for a new main hospital and new children's hospital.  Apple's involvement in Stanford's philanthropic efforts for the hospitals was &lt;a href="http://stanfordhospital.org/newsEvents/newsReleases/2011/corporate-partners.html"&gt;announced last year&lt;/a&gt; as part of a consortium also involving eBay, HP, Intel, Intuit and Oracle, but Apple's specific monetary commitment to the effort had not been revealed.&lt;blockquote&gt;Apple CEO Tim Cook held a town hall meeting last week to celebrate Apple's record quarter, and in addition to giving employees deep discounts on Apple products, we're now hearing that he spent quite a bit of time focusing on Apple's charitable contributions. According to our sources, Cook said that Apple has donated a total of &amp;#36;50 million to Stanford's hospitals, split into &amp;#36;25 million for a new main building and &amp;#36;25 million for a new children's hospital.&lt;/blockquote&gt;Cook also reportedly addressed Apple's work with (Product) RED, the Bono-led effort to fight AIDS, with Cook noting that the company has given over &amp;#36;50 million to the project through its special (Product) RED-branded iPods and accessories. Tied to Wednesday's announcement at a digital town hall was the government's release of a 67-page "playbook" to schools that promotes the use of digital textbooks and offers guidance. The administration hopes that dollars spent on traditional textbooks can instead go toward making digital learning more feasible.&lt;/blockquote&gt;The report notes that the K-12 textbook industry is an &amp;#36;8 billion per year market in the U.S. and that textbook companies have been working for a number of years on digital initiatives.  The primary roadblock, according to the textbook publishers, has been that schools simply don't have the hardware necessary to make the full commitment to digital learning.

		<title>OS X 10.7.3 Update 'CUI Error' Fixable in Many Cases with Combo Version</title>

		<description>Following yesterday's &lt;a href="http://www.macrumors.com/2012/02/01/apple-releases-os-x-10-7-3-with-new-language-support-and-bug-fixes/"&gt;release of OS X 10.7.3&lt;/a&gt;, a number of users in &lt;a href="http://forums.macrumors.com/showthread.php?t=1317887"&gt;our forums&lt;/a&gt; and at &lt;a href="https://discussions.apple.com/thread/3703113"&gt;Apple's discussion forums&lt;/a&gt; began reporting issues with the update.  The most serious of these issues seems to be widespread crashing of apps generally accompanied by an artwork error in the crash notice window in which the window's buttons are replaced with graphics showing "CUI" and question marks.

In general, users have found that applying the &lt;a href="http://support.apple.com/kb/DL1484"&gt;combo version&lt;/a&gt; of the OS X 10.7.3 update rather than the standard delta version typically offered via Software Update will fix the issues.  The combo update can even be applied over an existing installation that is exhibiting the problem.
&lt;br/&gt;

&lt;br/&gt;
With the crashing issues perhaps causing users difficulties in applying the combo update to fix the problem, &lt;i&gt;OS X Daily&lt;/i&gt; provides a &lt;a href="http://osxdaily.com/2012/02/01/fix-mac-os-x-10-7-3-update-problems-cui-errors-stuck-installs-and-crashes/"&gt;nice summary&lt;/a&gt; of how this can be accomplished:&lt;blockquote&gt;The simple formula is this:
&lt;br/&gt;

&lt;br/&gt;
- Download Mac OS X 10.7.3 Combo Updater (&lt;a href="http://support.apple.com/kb/DL1484"&gt;direct link&lt;/a&gt;)
&lt;br/&gt;
- Run the 10.7.3 Combo Updater on top of the existing 10.7.3 installation
&lt;br/&gt;
- Reboot
&lt;br/&gt;

&lt;br/&gt;
If you can’t get to the desktop of the Mac in question, you can &lt;a href="http://osxdaily.com/2010/04/07/how-to-boot-a-mac-in-target-disk-mode/"&gt;boot it with Target Disk Mode&lt;/a&gt; (Firewire or Thunderbolt required), and then point the 10.7.3 Combo Update at the troubled Mac and install it that way. If your OS X installation is totally screwed up and you can’t use target disk mode, you have a few choices:
&lt;br/&gt;

&lt;br/&gt;
1. Restore from a recent pre-10.7.3 Time Machine backup, then install the Combo Updater
&lt;br/&gt;
2. Boot from Recovery HD, a &lt;a href="http://osxdaily.com/2011/08/08/lion-recovery-disk-assistant-tool-makes-external-lion-boot-recovery-drives/"&gt;Recovery Drive&lt;/a&gt;, or &lt;a href="http://osxdaily.com/2011/07/08/make-a-bootable-mac-os-x-10-7-lion-installer-from-a-usb-flash-drive/"&gt;Lion USB drive&lt;/a&gt;, and reinstall everything
&lt;br/&gt;

&lt;br/&gt;
Not the best situation, but hopefully you have recent Time Machine backups.&lt;/blockquote&gt;The report also notes that users who already updated and are unaffected by the issues but still concerned that there may still be issues lurking can back up their systems and simply install the combo version for peace of mind.

The iPad obviously imposes some limitations on what can be done with the software compared with the full &lt;a href="http://www.avid.com/US/products/Avid-Studio"&gt;Avid Studio&lt;/a&gt; for Windows, but Avid suggests that it is full-featured enough to be used for editing on the go and is ideally suited as a companion to the desktop app.&lt;blockquote&gt;The idea is that the iPad app and the desktop software are complementary, [Avid vice president Tanguy] Leborgne said, so that users who want to create and edit projects on the go can do so, but ultimately preserve them by taking them to the PC.
&lt;br/&gt;

&lt;br/&gt;
The Avid iPad app does have some nice features, including an interface that includes a storyboard area and an editing timeline. And while some video editors rely heavily on customized keyboards or a mouse, others might appreciate the ability to pinch and squeeze videos and images to scale them on the touchscreen of the iPad, or the ability to move text and titles around with their fingers.&lt;/blockquote&gt;&lt;img src="http://images.macrumors.com/article-new/2012/02/avid_studio_ipad_2.jpg" alt="" title="avid_studio_ipad_2" width="480" height="351" class="aligncenter size-full wp-image-335466" /&gt;

We had expressed some doubts about the long lead time between event and launch.   Macotakara has had a mixed track record in the past, but has had enough hits that they continue to warrant attention.

The site is now reporting that while there will be an event in February, that it would be a "strange" (or &lt;a href="http://twitter.com/#!/Dmitri46/status/165014362422116352"&gt;unusual&lt;/a&gt;) event rather than the usual product announcement event:&lt;blockquote&gt;I reported that Apple was going to hold Special Event in early February according to Asian supplier and source from united states, but this report told a half-side of truth. Apple will hold "Strange" event at February instead of Special Event.&lt;/blockquote&gt;Meanwhile, they now report that the iPad 3 announcement and launch will both take places in March.

		<description>The &lt;em&gt;Commercial Times&lt;/em&gt; &lt;a href="http://www.digitimes.com/news/a20120202PB201.html"&gt;relays&lt;/a&gt; a report from Daiwa Securities that the iPhone 5 is expected to launch at Apple's Worldwide Developer's Conference (WWDC) to be held in June 2012.   Daiwa Securities also claims that the iPhone 5 will utilize "glass to glass" touch panel technology which will benefit TPK Holding and Wintek.

The summer launch claim is not new and has been &lt;a href="http://www.macrumors.com/2011/11/18/march-launch-for-slightly-thicker-ipad-3-iphone-with-4-inch-screen-in-summer/"&gt;echoed&lt;/a&gt; in previous reports.   So this could simply be a parroting of previous rumors.

Apple broke from tradition with the iPhone 4S by launching it in October of 2011.  Previous iPhone launches have occurred at Apple's annual WWDC conference.

Moscone's &lt;a href="http://www.moscone.com/site/do/event/list?nav.type=0&amp;nav.filter=1206&amp;nav.base=1206"&gt;event calendar&lt;/a&gt; has those corresponding dates blocked off for a "Corporate Meeting" which typically acts as a placeholder for WWDC. &lt;br/&gt;

		<description>Research firm IDC today &lt;a href="http://www.idc.com/getdoc.jsp?containerId=prUS23297412"&gt;released its estimates&lt;/a&gt; of global mobile phone sales for the fourth quarter of and full-year 2011, finding Apple moving past LG to claim third place in the rankings for the first time.  Apple was &lt;a href="http://www.macrumors.com/2011/07/28/apple-closing-on-lg-for-title-of-third-largest-mobile-phone-vendor-with-142-growth/"&gt;rapidly closing&lt;/a&gt; on LG by mid-2010, but fell back into fifth place behind ZTE during the third quarter as customers held off in anticipation of new iPhone hardware.  The strong surge from the iPhone 4S launch was then enough for Apple to move up in the year's final quarter and by a large enough margin that it was able pass LG in full-year numbers as well.

While Apple has been estimated to be neck-and-neck with Samsung for the crown of top smartphone manufacturer, Nokia and Samsung firmly hold down the top two spots in the overall mobile phone rankings on the volume of their lower-end feature phones.&lt;blockquote&gt;Apple jumped into the third spot globally from the fifth spot last quarter thanks to a record-breaking quarter of shipments. That represents the Cupertino-based company's highest-ever ranking on IDC's Top 5 global mobile phone leaderboard. The launch of Apple's iPhone 4S smartphone, which is now available in over 90 countries (as of mid-January), was the primary reason the company leapt over LG and ZTE in 4Q11. Device sales in the U.S. and Japan were particularly strong given extra sales days in the quarter and carrier distribution.&lt;/blockquote&gt;Apple's share of the market hit 8.7% in the fourth quarter and registered at 6.0% for the full year.  Steve Jobs famously noted during the iPhone's 2007 introduction that Apple was shooting to take 1% of the massive overall mobile phone market, and the company has clearly exceeded that goal and can now set its sights on a 10% quarterly share during the next spike in sales.

		<title>Apple's Hiring of an Outsider is Out of Character</title>

		<description>Earlier this week, Tim Cook announced the &lt;a href="http://www.macrumors.com/2012/01/31/apple-announces-john-browett-as-senior-vice-president-of-retail/"&gt;hiring of John Browett&lt;/a&gt; to replace Ron Johnson as the Senior Vice President of Retail at Apple. After spending more than 10 years at Apple, building the world's most successful retail chain from scratch, &lt;a href="http://www.macrumors.com/2011/11/01/retail-chief-ron-johnson-departs-apple-for-j-c-penney-no-successor-named/"&gt;Johnson was appointed CEO at JC Penney&lt;/a&gt; with the difficult task of turning around one of the country's most well-known department stores. 
&lt;br/&gt;

&lt;br/&gt;
Johnson announced his departure from Apple in June of 2011 and by August Apple's recruiters were in full-swing looking for a replacement. Curiously, for a company where nearly the &lt;a href="http://www.apple.com/pr/bios/"&gt;entire executive team&lt;/a&gt; is home-grown, reports emerged that Apple was using executive search-firm Egon Zehnder to assist with finding the perfect candidate. The &lt;em&gt;Wall Street Journal&lt;/em&gt; &lt;a href="http://www.macrumors.com/2011/08/03/apples-search-for-new-retail-chief-extending-internationally/"&gt;reported&lt;/a&gt; that Steve Jobs, at the time still on medical leave, was intimately involved in the decision to hire an outside firm "mainly because he wants to consider executives who are based abroad."

The entire executive team at Apple, aside from the just-hired Browett and &lt;a href="http://www.apple.com/pr/bios/bruce-sewell.html"&gt;Bruce Sewell&lt;/a&gt;, Apple's general counsel, has been with the company for more than 10 years. Aside from the general counsel position, Apple's leadership team has remained fairly consistent through the second Steve Jobs era.
&lt;br/&gt;

&lt;br/&gt;
Of nearly two dozen current and former executives, only a bare handful were hired from outside the company rather than being promoted from within, and only one -- general counsel Bruce Sewell -- is still with the firm. Apple's most famous crash-and-burn external hire was that of Mark Papermaster, a long-time IBMer who was hired by Apple in 2008 as Senior Vice President for Devices Hardware Engineering. After a lengthy court battle with IBM &lt;a href="http://www.macrumors.com/2008/10/30/apple-recruits-ibm-chip-designer-ibm-files-lawsuit/"&gt;over a non-compete clause&lt;/a&gt; he had signed, he was put in charge of the teams behind the iPod and iPhone, and presumably the early development of the iPad as well.
&lt;br/&gt;

&lt;br/&gt;
Papermaster finally started work at Apple on April 24, 2009, nearly six months after he was originally hired. He &lt;a href="http://www.macrumors.com/2010/08/07/iphone-hardware-engineering-chief-mark-papermaster-leaves-apple/"&gt;left the company&lt;/a&gt; after only 15 months, just after the &lt;a href="http://www.macrumors.com/2010/07/16/coverage-of-apples-iphone-4-press-conference/"&gt;Antennagate scandal&lt;/a&gt;.
&lt;br/&gt;

&lt;br/&gt;
He was in charge of the division that created the iPhone 4, and Papermaster's departure would seem to be that of an executive who fell on his sword over perceived issues with Apple's flagship product. However, Adam Lashinsky's book &lt;em&gt;&lt;a href="http://www.amazon.com/Inside-Apple-Americas-Admired-Secretive-Company/dp/145551215X"&gt;Inside Apple&lt;/a&gt;&lt;/em&gt; notes that there was more to it than a simple product miscue. Papermaster's years at IBM left him ill-prepared for the aggressive corporate culture at the top of Apple.
&lt;br/&gt;
&lt;blockquote&gt;Steve Jobs was on medical leave when Papermaster, who declined repeated requests to be interviewed, started at Apple. By the time Jobs returned, the word on Papermaster was that he wasn't fitting in. He wasn't seen as fighting hard for his division, a requisite internally. "Papermaster is a really nice guy, proverbially the guy you'd want to have a beer with," said someone who interacted with him during his time at Apple. "He is warm, patient, and willing to listen--just not the right qualities for Apple. It was so painfully obvious to everyone." It was said that when he came back to work, Jobs paid little attention to Papermaster, meaning the new executive had achieved "bozo" status in the founder's exacting judgement."&lt;/blockquote&gt;&lt;img src="http://images.macrumors.com/article-new/2012/02/executiveteam.jpg" alt="" title="executiveteam" width="560" height="328" class="aligncenter size-full wp-image-335406" /&gt;
&lt;br/&gt;
&lt;em&gt;Inside Apple&lt;/em&gt; is full of tales of the unique culture at Apple, such as the lack of profit-and-loss reports for individual divisions, like those that exist at most large companies. Apple's idiosyncratic culture and the complete lack of external hires at the top -- plus the short life-spans of those that have been tried -- mean John Browett, currently the CEO of European technology retailer Dixons Retail, could be in for a bumpy ride.
&lt;br/&gt;

Browett's hire has raised some concerns from Apple fans because of poor shopping experiences at the different retailers he was in charge of. Instead, Cook is hiring Browett for his enthusiasm for amazing customer service -- something Apple puts a lot of stock in -- as well as his international expertise.
&lt;br/&gt;

&lt;br/&gt;
John Browett is Tim Cook's first major hire as CEO, and a lot of analysts and Apple fans will be watching to see how it plays out. Though it is likely Steve Jobs had extensive input on the process both before he resigned as CEO and before he passed away, Tim Cook is indisputably in charge.
&lt;br/&gt;

&lt;br/&gt;
The first Apple Store opened in 2001, more than 10 years ago. Apple Retail's second 10 years are called the "decade of significance" within the company. It seems likely that retail will continue to be Apple's most noteworthy corporate initiative -- showcasing both the brand and its products to millions of visitors a week -- and John Browett, a complete outsider, is Apple's choice to run it.&lt;br/&gt;

The update is available via Software Update and Apple's download pages.&lt;blockquote&gt;The 10.7.3 update is recommended for all OS X Lion users and includes general operating system fixes that improve the stability, compatibility, and security of your Mac including fixes that:

- Add Catalan, Croatian, Greek, Hebrew, Romanian, Slovak, Thai, and Ukrainian language support

		<description>Earlier today, we reported on &lt;a href="http://www.macrumors.com/2012/02/01/new-photos-of-camera-equipped-ipod-nano-casing-surface/"&gt;new photos&lt;/a&gt; of an iPod nano casing that appears to support a rear-facing camera.  With similar photos having shown up in the past, it was unclear whether Apple was still pursuing the design for a future iPod nano.

&lt;a href="http://micgadget.com/21519/this-camera-equipped-ipod-nano-is-a-prototype-that-takes-overexposed-photos/"&gt;&lt;i&gt;M.I.C gadget&lt;/i&gt; now weighs in&lt;/a&gt; with claims that the pictured device is in fact a two-month old prototype but that Apple has been having difficulties with the 1.3-megapixel camera taking overexposed photos.&lt;blockquote&gt;It’s real, and it’s a two-month-old prototype that has big problems. It comes with an auto iris lens that can be affected by diffraction and blurring when the iris opening becomes too small in bright conditions. Ok, I gotta say it simply, it takes overexposed photos.
&lt;br/&gt;

&lt;br/&gt;
According to our factory sources, Apple have problems with the lens aperture for the next-gen iPod nano, the iris is not functioning correctly to allow the advantages of the low aperture to be utilized.&lt;/blockquote&gt;Interestingly, the report claims that the user interface for the camera features is finished and that Apple is looking to launch the device late this quarter or early next quarter once it finishes working out the camera issues.
&lt;br/&gt;

&lt;br/&gt;
The release would be a significant deviation from Apple's usual iPod refresh timeline, which has typically seen updates come in the September-October timeframe.  But with Apple shaking up its schedules in 2011 by pushing the iPhone back from its usual June release to take the iPod's place with an October debut, it is possible that other changes to the usual timeline are in store.
&lt;br/&gt;

&lt;br/&gt;
The iPods saw only very minor changes last October, with the iPod touch essentially gaining only a white option and a price drop while the iPod nano saw a price drop and a software update that was also compatible with the previous year's model.  The iPod shuffle and iPod classic received no updates at all, making Apple's 2011 iPod updates by far the most modest in the company's history.  Consequently, Apple could be looking to make more substantial changes to its iPod line, such as the release of a camera-equipped iPod nano, well ahead of the fall 2012 timeframe.

Specifically, Munster notes that he had recent discussion with a "major TV component supplier" which disclosed that Apple had contacted the company to inquire about their products.  The disclosure adds another data point to rumors from Asian supply chains that Apple has been working on a television set.  The relevant portion of Munster's report is &lt;a href="http://blogs.barrons.com/techtraderdaily/2012/02/01/apple-chat-with-tv-parts-vendor-points-to-apple-television-says-piper/"&gt;quoted by &lt;i&gt;Barron's&lt;/i&gt;&lt;/a&gt;:&lt;blockquote&gt;In Jan-12 we spoke with a major TV component supplier who has been contacted by Apple regarding various capabilities of their television display components. We see this as continued evidence that Apple is exploring production of a television. This latest data point follows Jan-11 meetings in Asia that led us to believe Apple was investing in manufacturing facilities for LCD displays ranging from 3.5″ mobile displays to 50″ television displays. In Sept-11 we met with a contact close to an Asian supplier who indicated that prototypes of an Apple Television are in the works. We believe TV hardware could be ready for a late CY12 launch, but the timeline and scope of a revamped content solution is more uncertain.&lt;/blockquote&gt;Observers have been looking for Apple's next major product line even as the iPad and iPhone experience booming sales and the Mac continues its resurgence with long-standing steady growth easily outpacing that of the overall PC industry. Rumors have since focused on an integrated television set involving iTunes and iCloud and controlled via Siri voice technology.  &lt;a href="http://www.macrumors.com/2012/01/04/apple-reportedly-working-on-42-televisions-as-content-talks-remain-stalled/"&gt;One report&lt;/a&gt; has claimed that Apple design chief Jony Ive has a 50-inch Apple television set prototype in his design lab, although various sources have at different times claimed a wide range of sizes for Apple's TV set, from 32 inches to over 50 inches.

Sources seems to suggest that Apple is shooting for a launch of its television set later this year or early next year.  What remains unknown is whether Apple will be able to make any revolutionary changes on the content side within that timeframe.  The company has made several efforts to work with content providers on ideas such as "best of TV" packages that would be made available through iTunes and enable users to in some cases eliminate their cable television subscriptions, but the company has reportedly made little progress in those negotiations.&lt;br/&gt;
